Depuis les attentats du 11 mars 2004 de Madrid se sont imposées quelques questions qui, d’après notre appréhension continentale de la démocratie, exigent des réponses urgentes. Certaines questions n’ont pas encore été formulées par les intellectuels en Europe et en Espagne. Comment peut-on combattre contre le terrorisme dans une démocratie? Celui-ci est intentionnellement désigné sous le nom de tradition continentale européenne, en opposition à la tradition anglo-saxonne. Cette dernière a de nouveau formulé la question de Hobbes et dans un cas (...) douteux plaide pour la sécurité au détriment de la liberté. Les événements du 11 mars ont prouvé que la scène terroriste est financée par le trafic d’armes et de drogue. Les systèmes démocratiques dont la politique repose sur des mesures d’économie peuvent-ils contrôler le marché noir? Toutes ces questions se rapportent à la vieille question notoire des limites de la liberté. Comment définir la liberté dans une société qui doit se pourvoir d’armes pour lutter contre les actes terroristes arbitraires, contre toute forme de gouvernement autoritaire et contre les différents aspects du fanatisme? Linguistic justice is about institutions distributing material and symbolic resources fairly when they are faced with linguistic diversity. However, no theory of linguistic justice has developed a systematic and comprehensive account of the moral dilemmas that take place in interpersonal linguistic relationships, in particular the power dynamics leading to (linguistic) domination. The aim of this article is to start building a general theory of linguistic domination, one that offers new conceptual tools for both empirical and normative analyses of linguistically diverse (...) societies. Using the republican tradition of thought, I argue that there is linguistic domination whenever someone is subject to the uncontrolled capacity for interference over their linguistic uses, ideology and acquisition by another agent. This article tests under what conditions this phenomenon takes place and the parties involved in it (both in terms of individuals and political institutions). (shrink)

El artículo profundiza en el concepto de mainstreaming de género, analizando sus dos componentes básicos: (i) su contenido sustantivo que es el enfoque de género, de acuerdo con el cual la desigualdad entre mujeres y varones es un fenómeno sistémico cuya raíz última sería el género entendido como la (re)construcción social de la diferencia entre los sexos y de las relaciones entre ellos; y (ii) el mainstreaming como estrategia para alcanzar la igualdad, estrategia consistente en incorporar la perspectiva de la (...) igualdad de género en todas las normas y en todas las políticas (transversalidad, enfoque global), estrategia que sería complementaria y no excluyente de la igualdad de trato y de las acciones positivas y que aspiraría a ser particularmente incisiva para el logro del mencionado objetivo. Teniendo en cuenta que la meta del mainstreaming de género es la transformación social, la modif icación de las relaciones entre los sexos, así como de sus representaciones sociales y la existencia de una gran ambigüedad en torno a cuál debe ser el sentido y la dirección de los cambios, en el trabajo se argumenta que la transformación social debe ir en la línea de superar tanto el asimilacionismo (asunción de los modelos masculinos por parte de las mujeres), como el dualismo entre mujeres y varones, el mantenimiento de esferas separadas y distintas, pues ambos hacen imposible la consecución de la igualdad real. La transfor- mación social, que requiere incorporar a los varones al cambio, debería orientarse hacia la consecución de una mezcla positiva (a positive form of melding), de un nuevo modelo de sociedad superador del androcentrismo, pues el paradigma de lo humano, susceptible de universalizarse, serían no sólo los valores “masculinos”, sino todas las cualidades, ca- pacidades y posibilidades humanas, tanto las que forman parte del modelo “masculino”, como las que forman parte del modelo “femenino”, pues todas ellas son valores humanos que cualquier ser humano puede practicar.Por último el artículo destaca las potencialidades que encierra la estrategia de Gender Mainstreaming y también los riesgos y las dif icultades que comporta. Politics is about managing conflict, about how we should live together. Many traditions of thought and political thinkers have nonetheless taken this shared space of conflict, this we the people, as a given. The people is considered as a necessary precondition for politics. What happens when a part of this we disagrees with that? When, for some, this shared community is not taken as a given and claim their right to secede and build their own independent political community. La industria de alimentos vegetales consume grandes volúmenes de agua de buena calidad y genera grandes cantida­des de agua residual. Uno de los sistemas que se pueden aplicar para reducir el consumo y el vertido de agua es la reutilización del agua de lavado. Para llevar a cabo la reutilización del agua sin comprometer la seguridad microbiológica y química de los alimentos es necesario optimizar el uso de agentes antimicrobia­nos. El cloro ha sido tradicionalmente el tratamiento de desinfec­ción usado por (...) la industria hortofrutícola para el agua de lavado. Sin embargo, su uso tiene la desventaja de la acumulación de subproductos de desinfección, lo que ha impulsado el estudio y el uso de desinfectantes alternativos como el ácido peroxiacéti­co. En cualquier caso, el mantenimiento de la seguridad micro­biológica y química de los alimentos vegetales frescos, en lo que respecta a la etapa de lavado, pasa por la selección de los límites operacionales que deben mantenerse en cuanto a la concentra­ción de desinfectante, así como la monitorización y control de los parámetros críticos relacionados con la desinfección, como es el contenido en materia orgánica. La optimización de la desinfec­ción tiene que tener en cuenta las peculiaridades de cada caso, incluyendo el tipo de producto lavado, el desinfectante usado, y el diseño y manejo de la línea de lavado. There is a particular moral theory in which human rights are conceived as indestructible rights. Using Dworkin’s words we could say this is a good way of taking rights seriously. However, we may also ask whether there is another way of taking rights as seriously as Dworkin says without being a supporter of that theory. From this point of view, perhaps human rights cannot be considered neither as absolute ; nor universally valid ; and not even inalienable. What does the Chilean Constitution say about euthanasia? When we read the Chilean Constitution we cannot find the word “euthanasia” in the text, and there is no such thing as a right to die, therefore the answer should apparently be that the Constitution does not say anything about euthanasia and, in short, euthanasia is not allowed. However, on a second reading we can find out some statements from which we can infer another answer. My aim is to show that there (...) is room for the acceptance of euthanasia in the Chilean Constitution, and in other similar Constitutions and international regulations in which freedom of conscience is granted. We discuss a recent approach to investigating cognitive control, which has the potential to deal with some of the challenges inherent in this endeavour. In a model-based approach, the researcher defines a formal, computational model that performs the task at hand and whose performance matches that of a research participant. The internal variables in such a model might then be taken as proxies for latent variables computed in the brain. We discuss the potential advantages of such an approach for the (...) study of the neural underpinnings of cognitive control and its pitfalls, and we make explicit the assumptions underlying the interpretation of data obtained using this approach. The results of evolutionary algorithms depend on population diversity that normally decreases by increasing the selection pressure from generation to generation. Usually, this can lead the evolution process to get stuck in local optima. This study is focused on mechanisms to avoid this undesired phenomenon by introducing parallel self-adapted differential evolution that decomposes a monolithic population into more variable-sized sub-populations and combining this with the characteristics of evolutionary multi-agent systems into a hybrid algorithm. The proposed hybrid algorithm operates with individuals (...) having some characteristics of agents, e.g. they act autonomously by selecting actions, with which they affect the state of the environment. Additionally, this algorithm incorporates two additional mechanisms: ageing and adaptive population growth, which help the individuals by decision-making. The proposed parallel differential evolution was applied to the CEC’18 benchmark function suite, while the produced results were compared with some traditional stochastic nature-inspired population-based and state-of-the-art algorithms. This essay argues that the practical reason approach to the study of social conventions (and social normativity more generally) fails to adequately account for the fluency of social action in environments that we experience as familiar. The practical reason approach, articulated most recently in Andrei Marmor’s Social Conventions: From Language to Law (2009) does help us, though not wholly adequately, to understand how we tend to react to, and experience, unfamiliar situations or unfamiliar behaviors, that is, those situations in which (...) a certain practice becomes problematic or is problematized, or where we are obliged to, or moved to, justify or deliberate. The reason why the practical reason approach is not wholly adequate when it comes to understanding unfamiliar situations or unfamiliar behaviors is that it tends to subsume the unfamiliar under the familiar, that is, it tends to negatively evaluate anything that is deemed to be not in accordance with the rules and reasons already familiar to the observer. This excludes the possibility of the observer having to transform himself or herself, and thus change what is familiar to him or her. (shrink)

A teaching method may not work for all students. Therefore, attention should be paid to the type of students entering the learning environment in order to explain how they perceive the learning environment and achieve. This study investigates students? perceptions and achievement in four learning environments that differed in the degree to which case-based and lecture-based learning were implemented (either separately or combined), hereby making use of students? motivational and learning profiles. Participants were 1098 first-year student teachers who took a (...) course on child development. Results showed that autonomously motivated deep-strategic learners were significantly more positive about each type of learning environment than little motivated and less pronounced deep-strategic learners. However, with regard to achievement, student profiles did not differ. Instead, the learning environment proved to be of significant influence: students in a gradually implemented case-based setting and a completely lecture-based setting scored significantly higher than students in a completely case-based setting. El presente trabajo analiza la configuración de los personajes femeninos inmigrantes y transmigrantes en las obras “La han despedido de nuevo” de Claudia Hernández y La fila india de Antonio Ortuño y observa los mecanismos de adaptación, las estrategias y las dinámicas sociales de las que se basan como forma de auto protección o de cuidado mutuo. Proponemos una lectura de la representación de las mujeres migrantes como sujetos complejos, activos, dotados de agencia y transgresores como forma de contrarrestar los (...) imaginarios consolidados por narrativas anteriores en los que los sujetos femeninos no han tenido protagonismo en su representación o en su estudio. Health is certainly a valuable asset in the life of every human being and of particular relevance for a flourishing childhood. As empirical research concerning the social determinants of health shows, its distribution can, at least to a certain extent, be influenced by the way a society is arranged. Many philosophers now acknowledge that a fair distribution of health has to be a central part of a just society and they discuss to what extent a right to health can be (...) justified. However, they do not typically distinguish between physical and mental health and neglect the special problems arising from these distinct, though related, perspectives. In this paper, we argue in favour of such a distinction and ask whether a minimally just society ought to include mental health among the goods that are to be distributed in a fair way among its children. Furthermore, we investigate the relationship between mental health and happiness and ask whether making mental health a subject of justice implies that children are entitled not only to a healthy but also to a happy childhood. Despite the positive impact of happiness on the lives of children, we conclude that happiness cannot be incorporated into a functional theory of justice, since it does not fully meet the criteria of objectivity, measurability and influenceability. In a questionnaire study on organ allocation 348 students of medicine (102) and economics (246) at the universities of Halle (114 students) and Hannover (234 students) responded to questions concerning their basic attitudes toward alternative criteria of organ allocation. Medical criteria were widely accepted by the respondents. Considerations concerning the patient's value to society were seen as being of minor importance. With respect to reciprocity, we could detect a high share of respondents who would favor former living donors and discriminate (...) against murderers. Among considerations of fairness, the criterion of waiting time gained the highest support. Furthermore, majorities favored the view that health-compromising behavior and differences in age should play a role. Economic considerations were strongly rejected as criteria of organ allocation. Experts in the field of organ transplantation had to rank order a set of 32 patients according to their priority in receiving a donated kidney. The patients were described by the five characteristics that are incorporated in the kidney allocation algorithm applied by Eurotransplant. The priority rankings as defined by the experts were analyzed and patterns of dedsion making identified in the rankings investigated in this study. All patterns could be explained by some type of lexicographical ranking. The larger group (...) of experts preordered tissue compatibility or, more technically speaking, the criterion of HLA match, while the complementary group applied the criterion of the length of waiting time first. Analyzing the finer decision structures of expert rankings and com paring the method of pattern exploration with a conjoint measurement analysis led to two follow-up questions: First, how can the value judgments of the experts be described adequately? Second, which type of aggregated ordering derived from the individual rankings represents them ‘best’? (shrink)

This article explores the maternal experiences of a heterogeneous group of 26 mothers from Granada. The aim is to analyse the needs and demands that these women express with regard to childrearing, using a qualitative methodology. The authors conducted in-depth interviews and analysed the discourses of the mothers following the hermeneutical method. The variables used for sample selection and the themes that emerged during the interviews revealed that the discourses of the mothers revolve around three dimensions: indifference, demands and resignation (...) regarding support for childrearing. The lack of paternal involvement in childrearing appears as a transversal dimension. This article shows that the material conditions of existence marked the differences in the responses of the women regarding support for childrearing, while the sexual division of labour and gender inequalities unified their discourses. This collection of original essays brings together leading legal historians and theorists to explore the oft-neglected but important relationship between these two disciplines. Legal historians have often been sceptical of theory. The methodology which informs their own work is often said to be an empirical one, of gathering information from the archives and presenting it in a narrative form. The narrative produced by history is often said to be provisional, insofar as further research in the archives might falsify present understandings (...) and demand revisions. On the other side, legal theorists are often dismissive of historical works. History itself seems to many theorists not to offer any jurisprudential insights of use for their projects: at best, history is a repository of data and examples, which may be drawn on by the theorist for her own purposes. The aim of this collection is to invite participants from both sides to ask what lessons legal history can bring to legal theory, and what legal theory can bring to history. What is the theorist to do with the empirical data generated by archival research? What theories should drive the historical enterprise, and what wider lessons can be learned from it? This collection brings together a number of major theorists and legal historians to debate these ideas. (shrink)

Review Essay of Stephen P. Turner, Explaining the Normative, 2010.

This paper offers an example of what may be called ‘an aesthetic history of legal and political thought’. Such a task engages in theorising historically the features of aesthetic traditions that enable and further normative inquiry, i.e. an exploration of the norms and values that might contribute to the good life and the common good. The three features offered in this paper as useful to identifying such aesthetic traditions are communality and interactivity, experimentalism, and exemplarity. The paper shows how each (...) of these features is present, in particular ways, in one specific aesthetic tradition, namely the declamatory tradition. Tracing the declamatory tradition back to Ancient Rome, and examining its influence in the English Renaissance, especially in Sir Thomas More’s response to Lucian’s declamatory thema, Tyrannicide, the paper argues that the particular ways in which declamatory practice combines the above three features enables those engaged in it to pursue normative inquiry. The paper argues that the integration of these three features is especially visible in one aspect of declamatory practice, namely the introduction and exchange of colores, i.e. changes in the narrative, introduced by declaimers and their audiences, which shed light on the possible motivation of a character, and thereby also invited shifts in affective allegiance and evaluative perspective. The paper argues that it is in large part through such introduction and exchange of colores that the declamatory tradition enables and furthers normative inquiry, and thus also offers a good reason for including the declamatory tradition in ‘an aesthetic history of legal and political thought’. Stripping the Virgin Mary of the myths, stories, and dogmas surrounding her is a task that has particularly appealed to a branch of feminist theology which seeks to reclaim her as a figure of female empowerment. This article aims to explore the transformation of Mary’s body into an element of resistance in the work of some contemporary artists. By depicting her nude or semi-nude, artists disrupt the gender values commonly associated with the Virgin and open up alternative possibilities of affirmative (...) selfhood through her body. I contend that, in these works, the Virgin’s body functions as a ‘relational’ body that enters into dialogue with hitherto marginalized categories, such as the carnal, the sensual, the notion of fleshly materiality, or even the excluded sexualities of transgender people. This paper argues that not only does history matter to legal epistemology, but also that understanding legal epistemology can yield a certain understanding of the past. The paper focuses on the common law practice of precedent and argues that there is no set of rules, principles, reasons or material facts that constitute the fixed or foundational content of past decisions, but rather that what is taken by a judge resolving a particular dispute to be the content of past decisions depends (...) on the active and creative construal of relevance engaged in by that judge. Precedents are better thought of as `thick resources with dynamic content'. Such content is constrained by a variety of stabilising practices, but never so constrained as to determine how it can be construed to be relevant. This image of law's past may offer a general view of the past as something with which we can actively and creatively relate in the course of coping with the present. (shrink)

Reflections or Dialogicals: Ways for Making up an Ethics. This purpose of this article is to analyze the relationship between reason and ethics in the thoughts ofLéon Brunschvicg and Gaston Bachelard. It will demonstrate that although the positions of these two authors have points in common as far as the development of their philosophical trajectories, there are also profound divergences in regards to their ethical conceptions. In affirming the passage from intellectual reason to moral consciousness, the ethical humanism of Brunschvicg (...) takes as foundation a monological conception of reason. In showing that the constitution of ethical principles is modeled after the dialogical nature of the scientific city, Bachelard opts for a conception of reason and ethics that passes thorough a reflection on the path taken by man, a path filled with contradictions, but that it is nonetheless as true as the one established by Brunschvicg.
